Use of the Services is at Your own risk. We host the Services on reputable platforms and take reasonable efforts to maintain availability and security. However, We make no explicit representations or warranties about the safety of Your individual use. These Terms are subject to change at any time. We will update the "Last updated" date above when changes take effect. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

To use the Services and to purchase any of our subscriptions or in-app products, You must be of legal age of majority in Your place of residence and, therefore, able to form a legally binding contract under applicable law. Anyone who does not meet these criteria is unauthorized and in violation of these Terms. The Services are not directed to children under 13 (or under 16 in the European Economic Area and the United Kingdom). By using the Services, You represent and warrant that You can form a legally binding contract under applicable law, are of legal age of majority where You reside, and agree to abide by these Terms.

To access certain features, You may need to create an account. You agree to provide accurate and current information and to keep it updated. You are responsible for maintaining the confidentiality of Your account credentials and for all activity that occurs under Your account. You agree to notify Us immediately at support@tradishrecipe.app if You learn of any unauthorized use of Your account.

You may sign in using third-party authentication providers such as Apple or Google. If You do, You agree to comply with the terms of those providers as well as these Terms.

Subject to Your compliance with these Terms, We grant You a limited, revocable, worldwide, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for Your personal, non-commercial use. This license does not grant You any right to:

All text, photographs, graphics, designs, icons, software, and other materials in the Services are owned by 31Forge, LLC or our licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Materials may not be copied, modified, reposted, or distributed without our prior express written permission.

Trademarks. "Tradish" and the Tradish logo are trademarks of 31Forge, LLC. A trademark application for Tradish is currently pending with the United States Patent and Trademark Office. All other trademarks displayed in the Services are the property of their respective owners.

We may prosecute infringement to the fullest extent permissible, including seeking damages and injunctive relief.

You retain ownership of the recipes, photos, comments, ratings, collections, and other content You submit to the Services ("User Content"). By submitting User Content, You grant 31Forge, LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, host, store, reproduce, modify, distribute, publicly perform, publicly display, and create derivative works of Your User Content for the purpose of operating, improving, and promoting the Services.

You represent and warrant that:

We may, but are not obligated to, review, edit, or remove User Content at our sole discretion. We are not responsible for User Content submitted by other users.

Tradish includes tools that let You save a personal copy of recipes from websites, social posts, photographs, and other sources You choose to import, similar to clipping a recipe into a private notebook or recipe box. Imported recipes are stored in Your private library for Your personal, non-commercial use.

Importing a recipe does not transfer ownership of the underlying content to You or to Us, and third-party content remains subject to the rights of its owner. Where available, We preserve source attribution (such as the original link and the creator's name or handle) with the imported copy.

You are responsible for how You use imported content. In particular, You agree not to publicly share, republish, or commercially exploit content that You do not own or have permission to use. Creating a public share link for a recipe makes it visible to anyone with the link; only create share links for recipes You created or otherwise have the right to share.

If You believe content available through the Services infringes Your copyright, see the Copyright complaints (DMCA) section below.

We respect the intellectual property rights of others and expect users of the Services to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), We will respond to properly submitted notices of alleged copyright infringement and will remove or disable access to material claimed to be infringing, including public recipe share pages.

To submit a copyright infringement notice, provide our copyright agent with the following:

Counter-notices. If You believe material You posted was removed or disabled by mistake or misidentification, You may submit a counter-notice containing the information required by 17 U.S.C. § 512(g)(3) to the same agent. We may restore the material unless the original complainant files a court action within the statutory period.

Repeat infringers. We will terminate the accounts of repeat infringers in appropriate circumstances.

Tradish may offer subscriptions and in-app purchases. The price, billing frequency, and features of each offering are described at the point of sale.

Apple App Store purchases. Subscriptions and in-app purchases made through the iOS App are processed by Apple and are subject to Apple's Standard EULA and refund policy. Refund requests must be submitted through Apple at reportaproblem.apple.com.

Google Play purchases. Subscriptions and in-app purchases made through the Android App are processed by Google and subject to Google's terms and refund policy.

Web purchases. Subscriptions purchased on the Site are processed by Stripe and governed by these Terms. Web subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal. You may cancel at any time from Your account settings. We do not provide refunds for partial billing periods, except where required by applicable law (including statutory withdrawal rights in the European Union and United Kingdom).

Statutory rights. Nothing in these Terms limits any non-waivable consumer rights You have under the law of Your country of residence.

The Services may contain affiliate links or referral codes. If You click an affiliate link or use a referral code and make a purchase, We may earn a commission at no extra cost to You. We disclaim any and all liability for purchases You make through affiliate links. We will use reasonable efforts to disclose affiliate relationships where required by applicable law (including the FTC's endorsement guidelines in the United States).

We are committed to making the Services accessible to everyone, including individuals with disabilities. We strive to comply with the Americans with Disabilities Act (ADA) and follow best practices in line with the Web Content Accessibility Guidelines (WCAG). THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that:

Recipes and dietary information. Recipes, ingredient lists, nutritional estimates, and dietary tags in the Services are provided for general informational purposes. They are not a substitute for professional medical, nutritional, or allergy advice. If You have a food allergy, medical condition, or other dietary concern, consult a qualified professional and verify ingredient information independently before preparing or consuming any recipe.

Some jurisdictions do not allow the disclaimer of certain warranties, so some of the disclaimers above may not apply to You.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 31FORGE, LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

Some jurisdictions do not allow the limitation of certain damages, so the above limitations may not apply to You in full. Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

You agree to indemnify, defend, and hold harmless 31Forge, LLC and its officers, members, employees, contractors, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (a) Your use of the Services; (b) Your User Content; (c) Your violation of these Terms; or (d) Your violation of any third party's rights, including intellectual property or privacy rights.

We may suspend or terminate Your access to the Services at any time, with or without notice, if We believe You have violated these Terms or for any other reason at our sole discretion. You may stop using the Services and delete Your account at any time. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, User Content license, disclaimers, limitation of liability, indemnification, and dispute resolution.

The Services may link to or integrate with third-party websites, apps, or services that We do not control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their terms and privacy policies.

If You are using the App on an iOS device, You acknowledge that:

These Terms and our Privacy Policy are governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

If You are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, You retain the benefit of any non-waivable rights granted by the law of Your country of residence.

Informal resolution. Before bringing a formal claim, You agree to first contact Us at support@tradishrecipe.app and attempt to resolve the dispute informally for at least 30 days.

Mediation. If the dispute is not resolved informally, You and 31Forge, LLC agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms (including their breach, termination, enforcement, interpretation, or validity) through good-faith mediation. Mediation will be conducted in St. Louis County, Missouri, with a mutually agreed-upon mediator. The parties will share mediation costs equally.

Arbitration. If the matter is not resolved through mediation within 30 days of the initial request for mediation (or a longer period if agreed by the parties), the dispute will be decided by binding arbitration in accordance with the procedural rules of the American Arbitration Association. The arbitration will take place in St. Louis County, Missouri. The arbitrator's decision is final and binding. The cost of the arbitrator will be shared equally; each party is responsible for its own attorneys' fees and expenses, unless the arbitrator decides otherwise.

Class action waiver. Disputes will be resolved on an individual basis only. You and 31Forge, LLC waive any right to participate in a class action, class arbitration, or representative proceeding.

Exceptions. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights, or from pursuing small-claims-court actions for qualifying disputes. EU and UK consumers may also bring proceedings in the courts of their country of residence as required by law.

To the extent a dispute is not subject to arbitration, the parties consent to the exclusive jurisdiction of the federal and state courts located in St. Louis County, Missouri, except where mandatory consumer law in Your country of residence grants You the right to sue in Your local courts.

These Terms and our Privacy Policy constitute the entire agreement between You and 31Forge, LLC regarding the Services and supersede any prior agreements. If any provision of these Terms is held to be unlawful or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision will not be deemed a waiver of that or any other provision.

You may not assign or transfer these Terms or Your account without our prior written consent. We may assign these Terms to any successor, affiliate, or acquirer without notice.
